1 Purpose of legal basis and retention period
1.1 Use of the T4G platform and selling vehicles
1.1.1 If you create and use a user account for the T4G portal via app or website, and / or you or your employer sells or offers to sell a vehicle to T4G, T4G processes your personal data. This is done in order to be able to submit a purchase offer and to be able to fulfill any subsequent purchase agreement, including in relation to payments and administration of your user account on the T4G portal. For these purposes, T4G processes the information that is entered on the T4G portal or that you otherwise provide to us, including, for example, your name, your payment information, your contact information, and other information associated with your user account.
1.1.2 If your employer is a party to the purchase agreement regarding the vehicle, the processing takes place on grounds of T4G's legitimate interest in being able to enter into and fulfill the purchase agreement, as it is deemed that T4G's legitimate interest in processing the personal data exceeds your interest in the data not being processed, cf. GDPR art. 6 pieces. 1, letter f. If you are a party in the purchase agreement regarding the vehicle, the processing takes place in order for T4G to enter into and fulfill an agreement to which you are a party, cf. Article 6 (1) of the GDPR. 1, letter b.
1.1.3 The personal information associated with your user account on the T4G portal is retained until the user account is deleted or has not been used for a period of 3 years. Personal information associated with the purchase agreement will be deleted 3 years after the agreement is fulfilled.
1.2 Inquiries and support
1.2.1 If you contact T4G, including in order to receive support, T4G processes your name, contact information and other information that you provide in connection with the inquiry, in order to respond to your inquiry.
1.2.2 The processing takes place on the basis of T4G's legitimate interest in being able to respond to your inquiries, as T4G's legitimate interest in processing the personal data is deemed to exceed your interest in the information not being processed, cf. GDPR art. 6 pieces. 1, letter f.
1.2.3 The personal information associated with your inquiry will be deleted after 3 months from the time of your most recent inquiry has been answered, unless at that time there is reason to believe that further correspondence will be necessary.
1.3 Marketing
1.3.1 If you subscribe to T4G's newsletter, T4G will process your name and email address to be able to communicate with you.
1.3.2 The processing is done in order to send you marketing in accordance with your consent, in accordance with Article 6 (1) of the GDPR. 1, letter a. You can revoke your consent at any time by using the contact information provided initially above. If you revoke your consent, this does not affect the legality of the processing that has taken place before.
1.3.3 The information will be deleted, when you revoke your consent or after a period of 12 months during which T4G has not communicated with you. However, for a period of up to 5 years after the consent has been revoked or expired, the documentation for your consent will be kept, and the legal basis for this processing is the legitimate interest of T4G in being able to document a previous consent, cf. GDPR Article 6, para. 1 (f), is deemed to exceed your interest in the information not being processed, cf. GDPR art.
1.4 Legal obligations and rights
1.4.1 T4G processes the information included in the invoice for the purpose of fulfilling its legal obligations in accordance with the provisions of the Accounting Act on the storage of accounting material.
1.4.2 The processing takes place in order for T4G to be able to fulfill its legal obligations in accordance with Chapter 5 of the Accounting Act, cf. Article 6 (1) of the GDPR. 1, letter c.
1.4.3 The information will be deleted after 5 years from the end of the financial year to which the information relates.
1.4.4 In addition, T4G may process the personal data referred to in points 1.1-1.4 for the purpose of establishing, exercising or defending its legal rights in connection with a dispute, a complaint or investigation initiated by a public authority. The legal basis for the processing is in that case T4G's legitimate interest in processing the information, as it is deemed to exceed your interest in the information not being processed, cf. GDPR art. 6 part 1, letter f. The information is deleted (unless there is another legal basis for its storage) when, after a specific assessment, it is no longer considered necessary for the sake of the dispute, complaint or investigation, and this may lead to a deviation from the other deletion deadlines specified in points 1.1-1.4.
2 Transfer of your personal information to third parties
2.1 Your information may be passed on to the following third parties:
a. Service providers and suppliers that assist with T4G's business activities, including, for example, hosting providers and IT service providers.
b. External advisers including e.g. accountants and lawyers.
c. Corporate group.
d. Public authorities to the extent required by law or court order, or where necessary to establish, exercise or defend the legal capacity of T4G rights.
e. Other third parties, if you agree to this or if they are involved in an acquisition, involving all or part of T4G's business or assets therein.
2.2 Your personal information will not be transferred to third parties established outside EU/EEA.
3 Your rights
3.1 Under certain conditions, you have the following rights under the data protection legislation:
a. The right of access:
You have the right to request information about or access to your personal information. However, there are exceptions, which means you do not always receive all of the information being processed.
b. Right to rectification:
You have the right to have incorrect personal information about you rectified. You also have the right to have personal information completed that is believed to be incomplete.
c. The right to deletion:
In certain cases, you have the right to request the deletion of your personal data.
d. The right to limit processing: In certain cases, you have the right to have the processing of your data limited.
e. The right to data portability:
You have the right to receive a copy of your personal information in a structured, commonly used and machine-readable format. If technically possible, you have the right to request that the personal data be transmitted directly to another company or person acting as data controller.
f. The right to object:
You have the right to object to the processing of your personal data. That means that you can stop or prevent the processing of your personal data. However, this only applies in certain cases and T4G does not have to stop processing your personal data, if there are legitimate reasons to continue processing.
g. Exercise of rights and the right to appeal:
If you wish to exercise the above rights, you may contact T4G upon use of the contact information listed at the top of this Personal Data Policy. If you wish to complain to the Danish Data Protection Agency about T4G's processing of your personal data, you can contact the Danish Data Protection Agency at www.datatilsynet.dk.
4 Amendments
4.1 This personal data policy may be amended, including as a result of changes in legislation or practice, additions of new functionality to the T4G platform and changes in relation to the service providers and providers used by T4G. Amendments will be announced on the T4G portal via app and website, and you will be notified of significant changes by email if you have provided this in connection with a processing covered by this personal data policy.
