1. General<\/strong>
1.1. These terms and conditions (the \"Terms and Conditions\") apply to any purchase offer and any purchase agreement between T4G One Europe ApS (\u201cT4G\u201d) and the seller of a vehicle (\u201cSeller\u201d).<\/p>\n

1.2.b When requesting a purchase offer from T4G, the Seller understands and accepts that the Terms and Conditions apply to purchase offers from T4G to Seller (\"Purchase Offer\"), as well as any later purchase agreement potentially concluded between T4G and Seller (\"Purchase Agreement\"). This applies regardless of the content of the Seller's sales and delivery terms, Seller's order confirmations or similar.<\/p>\n

1.3. Any changes made to a Purchase Agreement by the Seller, will only apply if accepted by T4G in writing.<\/p>\n

2. Purchase offer<\/strong>
2.1. Purchase offers are valid for 5 business days from the date of shipment from T4G, or until the stated expiration date stated in the Purchase Offer cf., however, items 2.4 - 2.5 below.<\/p>\n

2.2. Upon Seller's request for a Purchase Offer, Seller warrants that the vehicle has not been for sale on other platforms within 30 days prior to T4G's receipt of the request.<\/p>\n

2.3. To receive a Purchase Offer, the vehicle must be described correctly, including in relation to:<\/p>\n

a) Tax status
b) VAT status
c) Mileage driven
d) Mechanical condition
e) Cosmetic condition
f) Condition of the windshield
g) Use of the vehicle
h) Other comments<\/p>\n

2.4. Any Purchase Offer is contingent on the vehicle being properly described by the Seller. If the description of the vehicle is incomplete or otherwise inaccurate, T4G reserves the right to conduct an inspection of the vehicle with the purpose of submitting a new or corrected Purchase Offer.<\/p>\n

2.5. T4G reserves the right to make errors and omissions in the Purchase Offer, including in relation to the stated price.<\/p>\n

3. Delivery etc.<\/strong>
3.1. If the Seller accepts a Purchase Offer, the vehicle is considered purchased by T4G, which immediately thereafter initiates pick-up of the vehicle, unless otherwise agreed in writing.<\/p>\n

3.2. If the vehicle is not at the address provided by the Seller, or the vehicle is not for other reasons available for pickup, Seller will be billed for additional transport costs.<\/p>\n

3.3. Spare keys for the vehicle must be made available for the T4G together with the vehicle, unless otherwise stated cf. 2.3, letter h above. If spare keys are not provided, T4G reserves the right to order missing spare keys for a fee of DKK 2,500 + VAT, payable by Seller. T4G is not obliged to remunerate the Seller for any additional keys provided.<\/p>\n

3.4. Ladekabel\/Ladekabler til k\u00f8ret\u00f8jet skal stilles til r\u00e5dighed for T4G sammen med k\u00f8ret\u00f8jet, medmindre andet er angivet jf. pkt. 2.3, litra h ovenfor. Stilles Ladekabel\/Ladekabler ikke til r\u00e5dighed, forbeholder T4G sig retten til at bestille manglende Ladekabel\/Ladekabler mod et gebyr p\u00e5 DKK 2.500 + moms, som betales af S\u00e6lger. Ladekabel\/Ladekabler som eftersendes af S\u00e6lger, er T4G ikke pligtig til at godtg\u00f8re.<\/p>\n

3.5 S\u00e6lger har det fulde ansvar for at levere registreringsattest til T4G. Den komplette registreringsattest skal v\u00e6re os i h\u00e6nde senest 14 dage efter handlen er blevet accepteret. S\u00e5fremt attesten ikke er modtaget inden for tidsrammen, hj\u00e6lper T4G med at rekvirere en ny. S\u00e6lger vil blive p\u00e5lagt at d\u00e6kke udgiften for rekvivering af ny attest. Dette berammer sig til 750 kr.-DKK + moms.<\/span><\/p>\n

<\/p>\n

If the vehicle has a foreign registration certificate, and complete certificate is not in our possession 14 days after the bid has been accepted in T4G's Portal, we reserve the right to cancel Purchase Agreement.<\/p>\n

Please note<\/b> - all shipments containing registration certificates must be sent with a track and trace number.<\/p>\n

4. Price<\/strong>
4.1. The price is stated in the Purchase Agreement.<\/p>\n

4.2. Unless otherwise stated in the Purchase Agreement, prices are stated in DKK + Danish VAT.<\/p>\n

5. Payment<\/strong>
5.1. Efter indg\u00e5else af K\u00f8bsaftalen sender s\u00e6lger faktura p\u00e5 det aftalte bel\u00f8b til invoice@t4g.dk<\/p>\n

5.2. Betaling foretages senest 48 timer efter vi har modtaget komplet registreringsattest. <\/p>\n

5.3. Betaling foretages direkte til den af S\u00e6lger oplyste bankkonto senest 48 timer efter modtagelse af komplet registreringsattest.<\/p>\n

6. Confidentiality<\/strong>
6.1. The seller is granted access to the T4G Portal with a personal username and password. This information are strictly confidential and may not be passed on or used by others.<\/p>\n

7. Guarantees and liability for defects<\/strong>
7.1. The Seller guarantees to be the owner of and have full and unlimited control over the vehicle, including that the vehicle is not subject to any mortgage, attachment, right of purchase, right of first refusal or the like at the conclusion of the Purchase Agreement.<\/p>\n

7.2. The Seller guarantees that the vehicle is mechanically functional, including in relation to the engine, gearbox and differential.<\/p>\n

7.3. Desuden garanterer S\u00e6lger, at k\u00f8ret\u00f8jet er i samme kosmetiske stand som beskrevet af S\u00e6lger. T4G forbeholder sig retten til foretage nedslag i k\u00f8bsprisens pris med:<\/p>\n

a) DKK 3.000,00 + moms for hvert ekstra felt der kr\u00e6ver omlakering.
b) DKK 6.000,00 + moms for forruder med stenslag eller revner.<\/p>\n

7.4. T4G also reserves the right to terminate a Purchase Agreement and to return the vehicle at the Seller\u2019s expense, if there are mechanical and\/or cosmetic defects which the Seller has not stated, either at the conclusion of the Purchase Agreement or in the case that the vehicle, regardless of pt. 2.2., has been for sale on other platforms within 30 days prior to T4G's receiving the Purchase Offer.<\/p>\n

7.5. Seller is liable for any direct or indirect loss that T4G may suffer as a result of Seller\u2019s failure to fulfill their obligations under the Purchase Agreement including the Terms of Trade.<\/p>\n

7.6. S\u00e6lger har pligt til at handle i god tro. Er k\u00f8bstilbuddet v\u00e6sentligt over den forventede pris, har s\u00e6lger pligt til at oplyse os herom. Vi vil herefter bekr\u00e6fte om der er sket en fejl, eller om vi kan fastholde det fremsendte tilbud. Vurderer T4G at buddet er et fejlbud, vil vi forbeholde os retten til at annullere k\u00f8bstilbuddet\/handlen.<\/p>\n

8. Legislative and tax changes as well as force majeure<\/strong>
8.1. T4G reserves the right, without liability to T4G, to withdraw Purchase Offers and\/or cancel a Purchase agreement for changes in law and tax. T4G reserves the same right in case of force majeure, including pandemics (including Covid-19), epidemics, wars, riots, government interventions, strikes, blockades, import- or export bans, natural disasters, fire, lack of energy supply and labor or similar reasons which are beyond the reasonable control of T4G and which will render the performance of T4G significantly more burdensome.<\/p>\n

8.2. Upon termination of a Purchase Agreement, T4G returns the vehicle and relevant documents to Seller. Associated costs are borne by the Seller.<\/p>\n

9. Choice of law and venue<\/strong>
9.1. Any dispute between T4G and Seller is settled in accordance with Danish law, whereby the rules for choice of law and the International Sales Law (CISG) are disregarded.<\/p>\n

9.2. Any dispute that may arise between T4G and the Seller, including disputes concerning the conclusion of an agreement, \u2013 validity or termination must be decided by the Court in Kolding.
